Privacy Policy

1 – Kelly Smith, also advertises as The Pilates Physiotherapist, who hereafter for the purposes of this Privacy Policy will be referred to as Kelly Smith.  Kelly Smith is committed to protecting your privacy. Our privacy policy indicates to you what information we collect about you and how we use it. By using our services, in any capacity, you agree to the collection and use of information in accordance with this policy. We use your Personal Information for providing and improving our services to you.

 

2 - Personal Data 
a)  Unless you have provided it to us voluntarily through this website, I will not collect any personally identifiable data about you.  For the purposes of providing treatment, Kelly Smith, may require detailed medical information.  I will only collect what is relevant and necessary for your treatment.  During client contact, documentation will be collected, which may include details concerning your medication, treatment and other issues affecting your health.  This information may be stored as paper or electronic records and no copies are made.  This data is always held securely, is not shared with anyone not involved in your treatment, although for data storage purposes it may be handled by pre-vetted staff who have all signed an integrity and confidentiality agreement.  To be able to process your personal data it is a condition of any treatment that you give your explicit consent to allow Kelly Smith to document and process your personal medical data.  Contact details provided by you, which may include but not limited to, telephone numbers, email addresses, postal addresses may be used to remind you of future appointments and provide reports or other information concerning your treatment.  For online class clients we may ask and talk about health concerns through email when signing up. The details in these emails are not shared.  You information may be shared with othe healthcare professionals who are involved in your care.  This information will not be shared without your prior consent. 

b) When completing an enquiry form or becoming a member on the website, contact information and the data you have provided is stored.  This information is used to maintain contact and a service with you and may also be used to improve customer service.  This data will not be passed on to any third party organsiation and stored on the web-based database.
c) For marketing purposes, Kelly Smith may also use the contact details provided by you to respond to your enquiries, including making telephone contact and emailing information to you which they believe may be of interest to you.  This may include marketing, offers, information related to your classes and appointments.  If you wish to opt out of this contact, please email kellysmithphysio@gmail.com.
d) In making initial contact with Kelly Smith, you consent to her maintaining an initial dialogue with you until you either opt out (which you can do at any time by contacting me) or I decide to desist in promoting my services.  You well be asked to opt in to marketing emals, including information about service developments and future classes.  You can opt out at any time.  Kelly Smith does not broker your data and you can ask to be removed from the marketing database by emailing or phoning her using the contact details provided at the end of this Privacy Notice. 
e) Some basic personal data may be collected about you from the marketing forms and surveys you complete, from records of our correspondence and phone calls and details of your visits to my website.
f) Kelly Smith will only collect the information needed so that you can be provided with the services you require.  The business does not sell or broker your data. 

 

3 – Consent
Through agreeing to this privacy notice you are consenting to Kelly Smith processing your personal data for the purposes outlined. You can withdraw consent at any time by using the postal, email address or telephone number provided at the end of this Privacy Notice.

 

4 – Disclosure
Kelly Smith will keep your personal information safe and secure, only staff engaged in providing your treatment will have access to your patient records, although an administrator may have access to your contact details so that they can make appointments and manage your account. Kelly Smith will not disclose your Personal Information unless compelled to, in order to meet legal obligations, regulations or valid governmental requests. The practice may also enforce its Terms and Conditions, including investigating potential violations of its Terms and Conditions to detect, prevent or mitigate fraud or security or technical issues; or to protect against imminent harm to the rights, property or safety of its staff.

 

5 - Cookies/ website browsing information

We do not store any of your browsing history when you are viewing our website. However, we may use third party services such as Google Analytics that collect, monitor and analyse this type of information in order to increase our responsiveness to your needs. When you view our website, it may store some information on your computer in the form of a Cookie or similar file. With most Internet Browsers, you can erase Cookies from your computer hard drive, block all Cookies or receive a warning before a Cookie is stored.

6 - Retention Policy
Kelly Smith will process personal data during the duration of any treatment and will continue to store only the personal data needed for eight years after the contract has expired to meet any legal obligations.  After eight years all personal data will be deleted, unless basic information needs to be retained by me to meet our future obligations to you.  Records concerning minors who have received treatment will be retained until the child has reached the age of 25.

 

7 - Data storage
All Data is held in the United Kingdom. Kelly Smith does not store personal data outside the EEA.

 

8 - Your rights as a data subject
At any point whilst Kelly Smith is in possession of, or processing your personal data, all data subjects have the following rights:

  • Right of access – you have the right to request a copy of the information that I hold about you.

  • Right of rectification – you have a right to correct data that I hold about you that is inaccurate or incomplete.

  • Right to be forgotten – in certain circumstances you can ask for the data I hold about you to be erased from my records.

  • Right to restriction of processing – where certain conditions apply you have a right to restrict the processing.

  • Right of portability – you have the right to have the data I hold about you transferred to another organisation.

  • Right to object – you have the right to object to certain types of processing such as direct marketing.

  • Right to object to automated processing, including profiling – you also have the right not to be subject to the legal effects of automated processing or profiling.


In the event that Kelly Smith refuses your request under rights of access, I will provide you with a reason as to why, which you have the right to legally challenge.  At your request Kelly Smith can confirm what information she holds about you and how it is processed.
 

9 - To access what personal data is held, identification will be required

10 - Complaints
In the event that you wish to make a complaint about how your personal data is being processed by Kelly Smith you have the right to complain to me. If you do not get a response within 30 days, you can complain to the ICO.
